The plaintiff, Peter, has responded to the allegations made against him by Google in a legal dispute over the domain name "YouTubeAudio.com." Peter argues that his domain and business name are distinct from the YouTube trademark and are not intended to deceive users. He claims that both the domain registrar, GoDaddy.Com LLC, and the relevant regulatory authorities have acknowledged the distinction between his domain and the YouTube trademark.

 

Peter asserts that he lawfully acquired the "YouTubeAudio.com" domain name without objection from GoDaddy or any indication of trademark infringement. He also states that he registered the business name with the Corporate Affairs Commission and applied for a trademark with the Trademark Registry, both without objections related to trademark infringement.

 

Furthermore, Peter claims that the YouTubeAudio.com trademark and logo were accepted for registration in Class 16, a class in which none of Google's trademarks are registered. He also mentions that Google approved the use of "YTAudio" and the website youtubeaudio.com on its Google Playstore without objection until December 25, 2023, when it was unilaterally removed following the commencement of the lawsuit.

 

Peter asserts that Google also approved and registered YouTubeAudio.com on its Google AdSense program without objection, indicating that Google would not have registered the domain if it infringed on its trademarks.

 

During a court hearing, the plaintiff's lawyer informed the court of their intention to amend their statement of claim and writ of summons. Google's representative responded that they had just been served with the motion to amend and stated that the application was not yet ripe for hearing. The court subsequently adjourned the matter until April 18 for mention.

 

It's worth noting that GoDaddy.Com LLC, the domain registrar and the first defendant in the case, has not been represented in court nor filed any application since the case began.
