Federal High Court to Deliver Judgment in Rivers State Assembly Speaker's Case Against Governor and National Assemb

The Federal High Court in Abuja is poised to render a verdict on Monday in a case brought forth by Martin Amaewhule, the Speaker of the Rivers State House of Assembly, against Governor Siminalayi Fubara, the National Assembly, and others.

The Federal High Court in Abuja is set to deliver its judgment on Monday in a case brought by the Speaker of the Rivers State House of Assembly, Martin Amaewhule, against Governor Siminalayi Fubara, the National Assembly, and others. This information was communicated to the involved parties in a notice sent on Sunday. The case, identified as FHC/ABJ/CS/1613/2023, has the Rivers State House of Assembly and Amaewhule as the plaintiffs.

 

The defendants in the case include the National Assembly, the Senate President, Deputy Senate President, Senate Majority Leader, Senate Minority Leader, the House of Representatives Speaker, House Deputy Speaker, House Majority Leader, House Minority Leader, and the Clerk to the National Assembly. Additionally, the Governor of Rivers State, Attorney-General of Rivers, Commissioner of Finance, Accountant-General of Rivers, Rivers State Civil Service Commission, Inspector-General of Police, and Edison Ehie are also named as defendants.

 

The plaintiffs are seeking an injunction to prevent the first to the 10th defendants from considering any requests from Fubara to assume the functions of the Rivers State Assembly, including its legislative responsibilities. They are also seeking an injunction to prevent Fubara from obstructing or hindering the assembly under Amaewhule’s leadership as its speaker. Justice James Omotoso is the presiding judge in this case, which was filed during a period of crisis in the state.

 

The crisis arose due to strained relations between the former governor of the state, Nyesom Wike, and the governor. President Bola Tinubu intervened by convening a meeting in Abuja on December 18, where Wike and Fubara signed an eight-point resolution to resolve the political crisis.
