Man Released After 15 Years in Prison Without Charge or Trial, Court Orders

In a landmark ruling, an Ikeja High Court has ordered the release of Kazeen Adeshina, a man who has been unjustly detained for 15 years without charge or trial, citing a gross violation of his fundamental human rights.

An Ikeja High Court has ordered the release of Kazeen Adeshina, a man who has spent 15 years in a correctional facility without charge or trial. Justice Oyindamola Ogala ruled that Adeshina's detention was unjustifiable and a gross violation of his fundamental human rights. The judge stated that the presumption of innocence is sacrosanct and it is a travesty of justice for Adeshina to be held without trial for so long.

 

The court found that despite correspondence from the police to transfer Adeshina for arraignment since 2003, no action was taken, and Adeshina was left in custody without trial. The judge ordered the immediate and unconditional release of Adeshina from the Kirikiri Medium Correctional Centre. The applicant's counsel, Ben Okeke, had filed a fundamental rights enforcement suit against the Lagos State Attorney-General, Commissioner of Police, and Controller, Nigerian Correctional Service, Lagos State.

 

The court granted the applicant's prayers, declaring that the arrest and continued detention without a formal charge or trial was wrongful, illegal, and unjustifiable. The court also granted an injunction restraining the respondents from further breaching Adeshina's fundamental human rights and ordered his release on bail pending his arraignment in court.
