Supreme Court Upholds Federal Law Prohibiting Gun Possession for Domestic Violence Offenders

The US Supreme Court has made a landmark decision, upholding a federal law that prohibits individuals under domestic violence restraining orders from possessing guns, prioritizing public safety and protection of abuse victims over Second Amendment rights.

The US Supreme Court has upheld a federal law that prohibits individuals under domestic violence restraining orders from possessing guns. The 8-1 ruling, written by Chief Justice John Roberts, overturns a lower court's decision that struck down the 1994 law as a violation of the Second Amendment right to bear arms.

The law was challenged by a Texas man, Zackey Rahimi, who was subject to a restraining order for assaulting his girlfriend and later threatening to shoot her. Rahimi argued that the law violated his Second Amendment rights, but the Supreme Court ruled that the law is consistent with the nation's historical tradition of firearm regulation and targets individuals who pose a credible threat to public safety.

The Biden administration defended the law, emphasizing its critical role in protecting public safety and abuse victims, who are often women. The administration noted that guns pose a significant threat in domestic violence situations and are also dangerous to police officers who respond to these situations.

The ruling is a significant victory for gun control advocates, who have been pushing for stricter gun laws to combat firearms violence. Gun safety groups praised the decision, noting that it will help counter firearms violence and protect domestic violence victims. However, they also criticized the 5th Circuit's actions, which allowed the case to reach the Supreme Court.

The decision is a departure from the Supreme Court's recent expansion of gun rights, including a major expansion in 2022. The ruling suggests that the Court may be willing to consider the impact of gun laws on public safety, rather than solely focusing on the Second Amendment rights of individuals.
